Marketing is Not Dead (But Your Spam Database Is)
If you own a business in South Africa, POPIA might feel like a wet blanket on your sales strategy. You might be wondering, “How on earth do I get new clients if I can’t cold call or email them?”
Don’t panic. Marketing isn’t dead; it just requires a “permission-first” mindset. The days of buying a database of 10,000 random emails and “spraying and praying” are over. Here is how you can market your business legally, effectively, and without looking like a creep.
How to Market Legally (The “Dos”)
- Email Marketing: You can legally email a current customer who has bought something similar from you before. For new prospects, you get one strike. You can email them once to ask for their consent to send marketing. If they say no, or don’t reply, delete their data and walk away.
- WhatsApp Marketing: You must have a strict Opt-In. A user needs to tick a box on your website or fill out a form that explicitly says: “Yes, you may contact me via WhatsApp.”
- AI & Automation: Only use AI tools (like automated voice notes or chatbots) to message people who have already joined your “inner circle” and explicitly opted into your updates.
- Data Collection: Collect only what you need. If you are selling running shoes, you don’t need the customer’s ID number or marital status.
- Transparency: Always have a clear Privacy Policy on your website explaining exactly what you do with people’s data.
The “One-Strike” Rule for Outreach
Section 69 of POPIA is very clear. If you find a potential lead, you are allowed one “first contact” to ask if they want your services.
However, you must play by these rules:
- You must tell them exactly where you got their details.
- If they say “No,” “Stop,” or simply ignore you, you must immediately add them to a blacklist so you never accidentally contact them again.
- If you keep “following up” after they’ve ignored you, you are breaking the law.
The December 2024 Wake-Up Call
If you thought cold-calling was safe from POPIA’s electronic communication rules, think again. The Information Regulator issued a Guidance Note confirming that live telemarketing calls are considered electronic communications. This means the strict opt-in rules apply to phone calls, too.
The Bottom Line: Treat your prospects’ data like you would treat their physical property. Ask for permission before you enter, be polite while you are there, and if they ask you to leave, don’t climb back in through the bathroom window. Build a community of people who want to hear from you, and your conversion rates will soar.
